| Robbery |
The basic defense in robbery prosecutions is eyewitness
identification. Unlike a murder case where one’s state of mind can
reduce a Murder charge to a charge of Manslaughter or Negligent
Homicide, it is rare that one can say "Yes, I took the money,
but I didn't intend to do it."
Again, much as is the case in the representation of a person charged
with Assault, the primary defense is that of eyewitness identification.
All of the comments noted in the context of eyewitness identification
and assault are equally applicable in the defense of one accused
of robbery. |
